Menty - Terms of Use

Please read this Licensed Application End-User License Agreement ("Terms" or "EULA") carefully before using the Menty mobile application (the "Application"). This is a custom EULA operated by Seyfi Can Zeyrek ("us", "we", or "our"), an individual publisher.

By accessing or using the Application, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Application.

1. AGREEMENT TO TERMS
These Terms constitute a legally binding agreement made between you ("user", "you") and Seyfi Can Zeyrek. Your use of the Application confirms that you have read, understood, and agree to be bound by all of these Terms and our Privacy Policy.

2. IMPORTANT MEDICAL DISCLAIMER
Menty IS NOT A MEDICAL DEVICE. THE APPLICATION IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
The Application is a personal development and educational tool designed to increase self-awareness and support mental well-being based on the principles of Cognitive Behavioral Therapy (CBT), mindfulness, and self-compassion.

The content, guidance, and advice provided by the Application and Menty AI are for informational and educational purposes only.
Never disregard professional medical advice, consultation with a mental health professional (psychologist, psychiatrist), or emergency services.
If you have a medical condition or mental health concerns, consult a qualified health professional immediately. If you think you may have a medical emergency, call your local emergency number (e.g., 911 in the US, 112 in Turkey).
3. USER ELIGIBILITY
To use the Application, you must be at least 16 years of age or have reached the age of legal majority in your country.

4. SUBSCRIPTIONS AND PAYMENTS
Subscription Models: Menty offers automatically renewing monthly or yearly subscriptions to access certain features ("Premium").
Payment Processing: All payments are processed through the Apple App Store or Google Play Store and are subject to their respective terms and conditions. We do not see or store your credit card or payment information.
Auto-Renewal: Your subscription will automatically renew unless it is canceled at least 24 hours before the end of the current period.
Cancellation: You can manage and cancel your subscription through your App Store or Google Play Store account settings.
Refunds: Except when required by law, payments made are non-refundable. Please refer to Section 17 for warranty-related refund information specific to Apple.
5. USER-GENERATED CONTENT
The "Community" feature of the Application allows users to share content anonymously.

You are solely responsible for the content you share. Remember that your posts are anonymous but public to all users.
It is strictly prohibited to share content that is:
Unlawful, threatening, harassing, hateful, or defamatory.
An invasion of any person's privacy.
Harmful, obscene, or offensive.
An infringement of intellectual property rights.
We reserve the right to remove content and/or block any user from accessing the Application without prior notice for violating these rules.
6. PROHIBITED ACTIVITIES
You agree not to do any of the following while using the Application:

Use the Application for any illegal purpose.
Attempt to decipher, decompile, reverse engineer, or copy the source code of the Application, except as and only to the extent that any foregoing restriction is prohibited by applicable law.
Upload any viruses or malicious code that could harm the Application's servers or network.
Scrape or collect data about other users.
7. INTELLECTUAL PROPERTY RIGHTS
The Application itself, its original content (excluding User-Generated Content), features, design, text, graphics, and the Menty brand are the property of Seyfi Can Zeyrek and are protected by copyright, trademark, and other intellectual property laws.

You and Seyfi Can Zeyrek acknowledge that, in the event of any third-party claim that the Application or your possession and use of the Application infringes that third party’s intellectual property rights, Seyfi Can Zeyrek, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

8. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, SEYFİ CAN ZEYREK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING FROM THE USE OF, OR INABILITY TO USE, THE APPLICATION.

9. DISCLAIMER OF WARRANTIES
The Application is provided to you "AS IS" and "AS AVAILABLE". We make no warranty, express or implied, that the Application will be uninterrupted, error-free, or secure.

10. TERMINATION
We may terminate or suspend your access to the Application immediately, without prior notice, for any breach of these Terms. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms.

11. GOVERNING LAW AND JURISDICTION
These Terms shall be governed and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of İzmir, Turkey.

12. CHANGES TO TERMS
We reserve the right, at our sole discretion, to modify these Terms at any time. When we do, we will update the "Last Updated" date. Your continued use of the Application after the changes are posted constitutes your acceptance of the new Terms.

Apple App Store Additional Terms
14. ACKNOWLEDGEMENT
You and Seyfi Can Zeyrek acknowledge that this EULA is concluded between you and Seyfi Can Zeyrek only, and not with Apple Inc. ("Apple"). Seyfi Can Zeyrek, not Apple, is solely responsible for the Application and its content.

15. SCOPE OF LICENSE
The license granted to you for the Application is limited to a non-transferable license to use the Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license also allows for the Application to be accessed and used by other accounts associated with you via Family Sharing or volume purchasing. You may not distribute or make the Application available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, transfer, redistribute, or sublicense the Application, and if you sell your Apple device to a third party, you must remove the Application from the device before doing so.

16. MAINTENANCE AND SUPPORT
Seyfi Can Zeyrek is solely responsible for providing any maintenance and support services for the Application, as specified in this EULA, or as required under applicable law. You and Seyfi Can Zeyrek acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

17. WARRANTY
In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Seyfi Can Zeyrek.

18. PRODUCT CLAIMS
You and Seyfi Can Zeyrek acknowledge that Seyfi Can Zeyrek, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

19. LEGAL COMPLIANCE
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You may not use or otherwise export or re-export the Application except as authorized by United States law and the laws of the jurisdiction in which the Application was obtained.

20. THIRD-PARTY TERMS OF AGREEMENT
You must comply with applicable third-party terms of agreement when using the Application (e.g., your wireless data service agreement).

21. THIRD-PARTY BENEFICIARY
You and Seyfi Can Zeyrek acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against you as a third-party beneficiary thereof.

22. CONSENT TO USE OF DATA
You agree that Seyfi Can Zeyrek may collect and use technical data and related information — including but not limited to technical information about your device, system and application software, and peripherals — that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Application. Seyfi Can Zeyrek may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you. Our data handling practices for personally identifiable information are detailed in our Privacy Policy.

23. U.S. GOVERNMENT END USERS
The Application and related documentation are “Commercial Items,” as defined at 48 C.F.R. §2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation,” as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. The Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein.
